PATHTO1600 Terms of Service Last Updated: April 18, 2026 Welcome to PathTo1600. These Terms of Service ("Terms") govern your access to and use of the services, platform, and content provided by PathTo1600, LLC, a limited liability company organized under the laws of the State of Delaware ("PathTo1600," "we," "us," or "our"). By accessing or using our platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not access or use our services. 1. Acceptance of Terms You agree to these Terms by creating an account, clicking "Accept" or "I Agree," or otherwise accessing or using our platform. If you are using the platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms. 2. Description of Services PathTo1600 provides an educational platform, including: - SAT and standardized test preparation materials - Practice tests, quizzes, and progress tracking tools - Interactive learning tools and study guides - Community content, forums, and peer resources - Free and paid subscription plans We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. 3. Eligibility To use our platform, you must: - Be at least 13 years of age; - If between 13 and 17 years of age, have obtained verifiable parental or guardian consent; - Not be barred from receiving services under applicable law; and - Have full legal authority to enter into a binding agreement (or have a parent/guardian do so on your behalf). By registering, you represent and warrant that you meet these eligibility requirements. We may terminate accounts that we determine do not meet these requirements. 4. User Accounts You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to: - Provide accurate, current, and complete information during registration; - Promptly update your account information if it changes; - Notify us immediately at support@pathto1600.com of any unauthorized use of your account; and - Never share your account credentials with any third party. We are not liable for any loss or damage arising from your failure to protect your account credentials. 5. Acceptable Use Policy You agree not to use our Services to: - Violate any applicable local, state, national, or international law or regulation; - Infringe the intellectual property or other rights of any person or entity; - Upload or transmit viruses, malware, or any other malicious or harmful code; - Harass, abuse, threaten, defame, or harm any other user or third party; - Use any unauthorized automated means (bots, scrapers, scripts) to access the platform; - Engage in cheating, academic dishonesty, or sharing exam content in violation of test providers' rules; - Attempt to gain unauthorized access to any part of the platform or its infrastructure; - Sell, resell, or sublicense access to the platform without written permission; or - Interfere with or disrupt the integrity or performance of the Services. We reserve the right to suspend or terminate your account for any violation of this policy. 6. User Content You retain ownership of content you submit, post, or upload to the platform ("User Content"). By submitting User Content, you grant PathTo1600 a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content solely to the extent necessary to operate, improve, and promote the Services. You represent and warrant that: - You own or have the necessary rights to submit your User Content; - Your User Content does not infringe any third-party rights; and - Your User Content complies with these Terms and all applicable laws. We may, but are not obligated to, monitor, review, or remove User Content at our sole discretion, including content that violates these Terms or that we deem inappropriate. Removal of content does not constitute a waiver of any other remedies available to us. 7. Intellectual Property All content, features, and functionality on the platform-including but not limited to text, graphics, logos, icons, audio, video, data compilations, and software-are the exclusive property of PathTo1600 or its licensors and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for your personal, non-commercial educational purposes, subject to these Terms. You may not: - Copy, reproduce, republish, or distribute any platform content without our prior written consent; - Modify, create derivative works from, or reverse engineer any part of the platform; or - Remove any copyright, trademark, or proprietary notices. 8. Payments, Subscriptions, and Auto-Renewal 8.1 Subscription Plans PathTo1600 offers monthly and annual subscription plans. A complete description of plan features and current pricing is available at pathto1600.com/pricing. 8.2 Auto-Renewal — IMPORTANT DISCLOSURE YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD (MONTHLY OR ANNUALLY) AT THE THEN-CURRENT SUBSCRIPTION RATE, UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. By subscribing, you expressly authorize PathTo1600 to charge your payment method on file for each renewal period without further action from you. Before each renewal, we will send a reminder notice to the email address associated with your account at least 3 days prior to the renewal date for monthly plans and at least 30 days prior for annual plans, disclosing the renewal date and amount to be charged. 8.3 How to Cancel You may cancel your subscription at any time using any of the following methods: - Account Settings: Log in -> Account -> Subscription -> Cancel Subscription; - Email: Send a cancellation request to support@pathto1600.com with the subject line "Cancel Subscription"; or - Support Chat: Contact us via the live chat widget on pathto1600.com. Cancellation takes effect at the end of the current billing period. You will retain access to paid features through the end of the period for which you have already paid. We will send a cancellation confirmation email upon processing. 8.4 Refund Policy All subscription fees are generally non-refundable. However, we will issue a full refund in the following specific circumstances: - You request a refund within 7 days of your initial subscription purchase and have not accessed more than 10% of the paid content; - You were charged after canceling your subscription in accordance with Section 8.3; - A technical error caused by PathTo1600 resulted in a duplicate or erroneous charge; or - Applicable law in your jurisdiction requires a refund. To request a refund, contact support@pathto1600.com within the applicable window with your account email and the reason for your request. Refunds, when issued, will be returned to the original payment method within 5-10 business days. We reserve the right to deny refund requests that do not meet the criteria above. 8.5 Price Changes We may change subscription pricing at any time. For existing subscribers, price changes will take effect at your next renewal period, and we will notify you at least 30 days in advance via the email on your account. Continued use of the platform after the effective date of a price change constitutes your acceptance of the new pricing. 9. Copyright Policy and DMCA PathTo1600 respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA"). We respond to notices of alleged copyright infringement that comply with applicable law. 9.1 Reporting Infringement If you believe that any content on our platform infringes your copyright, please send a written notice to our designated DMCA agent at dmca@pathto1600.com containing: - A physical or electronic signature of the copyright owner or authorized agent; - Identification of the copyrighted work claimed to have been infringed; - Identification of the allegedly infringing material and information sufficient to locate it on our platform; - Your contact information (name, address, phone, email); - A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law; and - A statement, under penalty of perjury, that the information in the notice is accurate and you are authorized to act on behalf of the copyright owner. 9.2 Counter-Notices and Repeat Infringers If you believe your content was removed in error, you may file a counter-notice with the information required under the DMCA. We will reinstate content in accordance with the DMCA process if a valid counter-notice is received and no court order is obtained by the complainant. We reserve the right to terminate the accounts of users who are determined to be repeat infringers. 10. Privacy and Data Your use of the platform is also governed by our Privacy Policy, available at pathto1600.com/privacy, which is incorporated into these Terms by this reference. By using our Services, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. We comply with applicable privacy laws, including the California Consumer Privacy Act (CCPA) and the Children's Online Privacy Protection Act (COPPA). Users who are California residents have specific rights regarding their personal information, as described in our Privacy Policy. We do not knowingly collect personal information from children under 13 without verifiable parental consent. 11. Third-Party Services Our platform may contain links to, or integrations with, third-party websites, services, and content ("Third-Party Services"). These Third-Party Services are not under our control, and we are not responsible for their content, privacy practices, or terms. We provide links only as a convenience and do not endorse or make any representations about Third-Party Services. Your use of Third-Party Services is at your own risk and subject to those parties' terms. 12. Disclaimers TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. PATHTO1600 DOES NOT WARRANT THAT: - THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; - ANY DEFECTS WILL BE CORRECTED; - THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR - THE RESULTS OBTAINED FROM USING THE SERVICES WILL BE ACCURATE OR RELIABLE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM PATHTO1600 OR THROUGH THE SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. 13. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PATHTO1600, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY: - INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; - LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES; - BUSINESS INTERRUPTION OR COST OF SUBSTITUTE SERVICES; OR - LOSS OF DATA OR FAILURE TO STORE ANY CONTENT, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PATHTO1600'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE TOTAL FEES PAID BY YOU TO PATHTO1600 IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE FOREGOING LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVEN IF THE REMEDY FAILS ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. 14. Indemnification You agree to defend, indemnify, and hold harmless PathTo1600, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: - Your use of or inability to use the Services; - Your User Content; - Your violation of these Terms; - Your violation of any applicable law or regulation; or - Your violation of any third-party rights, including intellectual property rights. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claims. 15. Force Majeure PathTo1600 will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control ("Force Majeure Events"), including but not limited to: natural disasters; acts of government or regulatory authorities; power failures; internet or telecommunications outages; cyberattacks or security breaches by third parties; strikes, lockouts, or other labor disputes; or pandemics or public health emergencies. If a Force Majeure Event occurs, we will make reasonable efforts to notify affected users and resume Services as soon as practicable. 16. Termination 16.1 Termination by PathTo1600 We may suspend or permanently terminate your access to the Services, with or without notice, for any reason, including if we believe you have: - Violated these Terms or our Acceptable Use Policy; - Engaged in fraudulent, abusive, or illegal activity; - Failed to pay applicable fees; or - Posed a risk to the security or integrity of the platform or other users. 16.2 Termination by You You may terminate your account at any time by contacting support@pathto1600.com. Termination does not entitle you to a refund except as described in Section 8.4. 16.3 Effect of Termination Upon termination of your account, your right to use the Services ceases immediately. We may delete your account data in accordance with our Privacy Policy. No refunds will be issued for violations of these Terms. 16.4 Survival The following sections will survive any expiration or termination of these Terms and continue in full force and effect: Section 6 (User Content license granted to us), Section 7 (Intellectual Property), Section 8.4 (Refund Policy), Section 9 (DMCA), Section 12 (Disclaimers), Section 13 (Limitation of Liability), Section 14 (Indemnification), Section 17 (Dispute Resolution), and Section 18 (Governing Law). 17. Dispute Resolution and Arbitration Agreement PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. 17.1 Informal Resolution Before initiating any formal dispute, you agree to contact us at support@pathto1600.com and give us 30 days to attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may proceed to arbitration as described below. 17.2 Binding Arbitration Except as provided in Section 17.4, you and PathTo1600 agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services—including questions of arbitrability—will be resolved exclusively by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (available at adr.org), as modified by these Terms. The arbitration will be conducted: - Virtually, by video or telephone, unless you or PathTo1600 requests an in-person hearing; - In the English language; and - In the county where you reside or in Delaware, at your election. 17.3 Arbitration Fees and Costs Filing fees will be allocated per the AAA's Consumer Arbitration Rules. PathTo1600 will pay all AAA arbitration fees for claims under $10,000, unless the arbitrator determines your claim is frivolous. Each party will bear its own attorneys' fees, except as otherwise required by applicable law or awarded by the arbitrator in accordance with applicable law. 17.4 Exceptions to Arbitration Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction. Either party may also seek emergency injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information, without waiving the right to arbitrate other claims. 17.5 No Class Actions YOU AND PATHTO1600 AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. 17.6 Opt-Out Right You have the right to opt out of this arbitration agreement by sending written notice to legal@pathto1600.com within 30 days of first creating your account or (for existing users) within 30 days of the effective date of this version of the Terms. Your opt-out notice must include your name, account email, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms. 17.7 Severability If any portion of this Section 17 is found to be unenforceable, only that portion will be severed. The remainder of this arbitration agreement will continue in full force and effect, except that if the class action waiver in Section 17.5 is found unenforceable, the entire arbitration agreement will be null and void. 18. Governing Law and Venue These Terms and any dispute arising out of or related to them or the Services will be governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. For any claims not subject to arbitration under Section 17 (including small claims and IP injunctions), you and PathTo1600 each consent to the exclusive personal jurisdiction and venue of the state and federal courts located in New Castle County, Delaware. 19. Changes to These Terms We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, for material changes, notify you via email to the address associated with your account or via a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Services before the effective date and cancel your subscription in accordance with Section 8.3. 20. Miscellaneous Entire Agreement: These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and PathTo1600 regarding the Services and supersede all prior agreements. Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will continue in full force and effect. Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction. Notices: We may provide notices to you by email, platform notification, or posting to the platform. Notices to us must be sent to support@pathto1600.com. Relationship: These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship between you and PathTo1600. Headings: Section headings are for convenience only and do not affect the interpretation of these Terms. 21.
